These Terms of Service (“Terms”) govern your access to and use of the website funtoyzones.com (the “Site”), including any purchases of products (toys and gifts) offered by GLOBALPIVOT SAVINGS LLC (317 Jarvis Ln, Louisville, KY 40207) (“Funtoys”, “we”, “us”, or “our”). By using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. For any questions, contact us at global@funtoyzones.com.

1. Eligibility

By using our Site, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.

  • If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

  • You have the legal capacity to enter into a binding contract.

  • You will provide accurate, current, and complete information during registration and checkout.

2. Account Registration

You may browse our Site without creating an account. However, to place an order, you may choose to create an account or checkout as a guest. If you create an account:

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your account.

  • You agree to notify us immediately of any unauthorized use of your account at global@funtoyzones.com.

  • We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for more than 24 months.

3. Products and Pricing

Products: Funtoys offers a variety of toys and gifts. Product descriptions, images, specifications, and availability are subject to change without notice. While we strive for accuracy, we do not warrant that product descriptions or other content are error-free. If a product offered by us is not as described, your sole remedy is to return it in accordance with our Return Policy.

Pricing: All prices are listed in EUR (Euro). Prices exclude shipping costs, which are calculated at checkout. We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders that have already been accepted by us.

Typographical Errors: In the event a product is listed at an incorrect price or with incorrect information due to a typographical error, we reserve the right to refuse, cancel, or reverse any orders placed for that product, even after you have received an order confirmation. If we cancel an order after payment has been processed, we will issue a full refund.

4. Orders and Acceptance

When you place an order through the Site, you are making an offer to purchase the products in your cart. Order acceptance is subject to our discretion. We will send you an order acknowledgment email confirming receipt of your order. This does not constitute acceptance. Acceptance occurs when we ship the product(s) and send you a shipping confirmation email. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability

  • Payment verification failure

  • Suspected fraud or unauthorized transaction

  • Pricing error

  • Shipping restrictions

If we cancel your order after payment, we will refund the full amount.

5. Payment

We accept various payment methods as displayed at checkout. All payments are processed in EUR. By providing a payment method, you represent that you are authorized to use that payment method. You agree to pay all charges incurred by you or any user of your account or payment method at the prices in effect when such charges are incurred. We use third-party payment processors (e.g., Stripe, PayPal). We do not store your full payment card details. If your payment fails, we may contact you to arrange an alternative method.

6. Shipping and Delivery

Shipping terms are detailed in our separate Shipping Policy, which is incorporated into these Terms by reference. Delivery estimates are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier (for shipments) or upon delivery to your address (for EU customers, risk passes upon physical delivery to you). For EU consumers, under the Consumer Rights Directive, risk passes when you take physical possession of the goods.

7. Returns and Refunds

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.

8. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.

  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.

  • Interfere with or disrupt the Site or servers, including introducing viruses, malware, or other harmful code.

  • Use robots, scrapers, or automated tools to access the Site for any purpose without our prior written permission.

  • Copy, reproduce, distribute, or create derivative works of any content on the Site (including product images, descriptions, and logos) without our consent.

  • Post false, misleading, or fraudulent information.

  • Harass, abuse, or harm another person, including other customers or our staff.

Violation of these prohibitions may result in immediate termination of your access and legal action.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, software, and compilations, is the property of Funtoys or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The Funtoys name and logo are our trademarks. You may not use our trademarks without our prior written consent. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other license is granted.

10. User-Generated Content

If you post reviews, comments, photos, or other content to the Site (e.g., product reviews), you grant Funtoys a worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, and display such content in connection with our business. You represent that you own or have permission to post such content and that it does not violate any third-party rights or applicable laws. We reserve the right to remove any user-generated content for any reason.

11. Third-Party Links

Our Site may contain links to third-party websites or services (e.g., social media, manufacturer sites). We do not control or endorse those websites. We are not responsible for their content, privacy practices, or terms. Your interactions with third-party websites are at your own risk.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR SERVER IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS (INCLUDING CERTAIN EU MEMBER STATES) DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. FOR EU CONSUMERS, YOUR STATUTORY RIGHTS (e.g., that products are of satisfactory quality and fit for purpose) ARE NOT AFFECTED BY THIS DISCLAIMER.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FUNTOYS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR €50 IF NO PURCHASE WAS MADE. FOR EU CONSUMERS, THIS LIMITATION DOES NOT APPLY TO (I) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, (II) DAMAGE CAUSED BY OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE, OR (III) LIABILITY UNDER PRODUCT LIABILITY LAWS. STATUTORY CONSUMER RIGHTS REMAIN UNAFFECTED.

14. Indemnification

You agree to indemnify, defend, and hold harmless Funtoys and its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of these Terms.

  • Your misuse of the Site or products.

  • Your violation of any law or third-party rights.

  • Any content you post or submit.

15. Termination

We may terminate or suspend your access to the Site, including your account, immediately without prior notice or liability for any reason, including if you breach these Terms. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (e.g., intellectual property, warranty disclaimers, limitation of liability, indemnification) shall survive.

16. Governing Law and Dispute Resolution

For customers outside the European Union: These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Jefferson County, Kentucky. You consent to the personal jurisdiction of such courts.

For customers in the European Union: If you are a consumer residing in the EU, you benefit from the mandatory consumer protection laws of your country of residence. These Terms do not limit your statutory rights. Disputes may be brought in the courts of your country of residence. We also offer access to the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we will cooperate in good faith.

17. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if the delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, pandemics, strikes, supplier failures, postal or carrier delays, or government actions.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return Policy, and any other legal notices published on the Site, constitute the entire agreement between you and Funtoys regarding your use of the Site and supersede any prior agreements.

20. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have an account) or by posting a prominent notice on the Site at least 15 days before the changes take effect. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Site.
